Remedial action pursued against Summerland building

Do Not Occupy notice was earlier issued for building on Summerland property

An Illegal Occupancy letter was issued June 21, 2024 for a Hillborn Street property in Summerland. A Do Not Occupy letter had been sent on May 24 of that year.

The municipality of Summerland is taking measures to bring a property on Hillborn Street into compliance with the municipality香蕉视频直播檚 building bylaw, the B.C. Building Code and the B.C. Fire Code.

At its meeting on March 25, council voted to issue a remedial action order to bring the property into compliance. Municipal staff will also provide formal notice of placement of the Section 57 Notice on Title for works completed without a valid building permit and required inspections.

The building on the property, at 7311 Hillborn St., is being used as a cherry sorting plant.

The municipality has had a long history of problems with this property, dating back close to 18 years.

Municipal staff said the building was constructed in 2021, but the required inspections have not been done.

The municipality has issued Do Not Occupy notices and has taken other enforcement measures, including ticketing. However, the property is still not in compliance, Tristan Hamersley, a building official said in a report to council.

Efforts were also made in late 2023 to bring the property into compliance. In November 2023, council deferred a motion to file a Notice on Title against the property until April 30, 2025.

The facility has operated for the past two sorting seasons, in 2023 and 2024.

The municipality has not received building permit applications to bring the building into compliance or to demolish the building.

Multiple notices have been sent to the owners in an effort to resolve the non-compliance issue.

Hamersly said an inspection in June 2022 showed structural deficiencies and non-conforming details.

While municipal staff recommended taking measures on this property, the costs could be noticeable. The cost of a consent order is estimated at $$5,000 to $10,000, while going to trial could cost $20,000 to $25,000.

Coun. Adrienne Betts said the building needs to be brought into compliance for the safety of the workers.

Coun. Richard Barkwill said the issue needs to be addressed and resolved. 香蕉视频直播淎t some point, enough is enough when it comes to health and safety questions,香蕉视频直播 he said.
