Property outside Penticton facing injunction for unfinished 2006 permit

The property has failed to complete a building permit first issued almost 19 years ago

A property on Green Mountain Road that first had a building permit issued in 2006 hasn't completed one, almost 19 years later.

The local government is looking to come down on a property on Green Mountain Road outside Penticton after five successive permits have failed to be completed. 

The Regional District of Okanagan Similkameen (RDOS) Board will be presented on April 3 with options to either simply place a notice on title for the property, which will show up if it is attempted to be sold, or move to injunctive action. 

The property, located at 2521 Green Mountain Rd., had initially applied for a building permit for a single family home in July 2006, with four more permits being issued as the previous one expired. 

The most recent permit was issued in 2021, and had its deadline extended to August 2024. 

The staff report to the RDOS states that the property has not been fully inspected, and that as a result it is being occupied without approval and has health- and safety-related deficiencies. 

Those deficiencies have put the property at the highest level of concern for the RDOS, with the recommendation of both a notice on title and injunctive action to be brought forward and filed in court.
