Two years after he was last in court, former Penticton Mayor John Vassilaki has sued his nephews for the third time and the second time over the same Main Street property.
This time, the former mayor wants to force the property to be sold so he can collect his half stake and finish cutting ties.
The March 26 lawsuit, filed in Kelowna under his birth name of John Vassilikakis, says that the relationship with his nephews George and Florio Vassilikakis has deteriorated over recent years and he wants his stake in the Cellar Wine Bar property at 410/412 Main Street.
Whether the stake is bought out by his nephews or through the sale of the property at the open market are both listed as options.
In 2021, Vassilaki sued his family over alleged unpaid rent and dealings around the Cellar Wine Bar and the property.
Vassilaki dropped his original 2021 claim against his family in 2023 after his brother had brought forward a counterclaim alleging he was physically attacked by his brother during an unrelated family argument that happened in 2020.
A Supreme Court Justice later ruled against Vassilaki and awarded $14,000 to his brother after finding Vassilaki had committed the tort of battery.
The second lawsuit Vassilaki filed, and subsequently lost at trial, was over his brother and nephews freezing Vassilaki and his son out as directors over the family business.
Prior to the resolution of both lawsuits, Vassilaki lost his 2022 mayoral reelection bid and has largely stepped back from the public eye.
According to the recent March 26 claim, the Main Street property is 50 per cent Vassilaki香蕉视频直播檚 and was valued at $2.1 million during the battle over his first lawsuit.
The remaining 50 per cent ownership is allegedly split equally between his nephews.
No response to the claim has been filed yet in court and the claims have not been tested by a judge.
